I'm being wrongly accused of vandalism, stalking, and harrassment of an individual down the road. I have never done the things I am being accussed of; however, it's her word against mine. I now have a restraining order and have to appear in court. What are my options? Can I countersue for slander? This has to reported to my job and I now cannot carry a firearm. It also will be investigated through my work.

This is a very unfortunate situation that you are in. I know what you are dealing with and how it feels to be falsely accused! Many years ago a crazy neighbor pulled the same stuff on me! I was devastated! Everything she said I did to her is what she did to me!!! Unfortunately these types get you to dance to their tune , by having to go through the court junk and all, but in the long run you will win out. She has to prove everything and can't, as you did not do anything. The case will be dismissed! Don't counter sue now, that would just make things worse. Wait till you are cleared then , if your up for it, charge her with using the law to harass you, filing false charges etc.etc. Good luck.

rootzgirl34, you ever hear of an unimportant little item called the Second Amendment of the Constitution of the United States of America? Ever hear of the right of self-defense? Not all of us live in gated communities or have daddies rich enough to hire us bodyguards.

SARA S, you need to get a lawyer! Don't let this go unanswered or you will be robbed of your rights, at least until the Lautenberg Amendment gets repealed.

In the meantime, DO NOT HAVE ANY CONTACT OF ANY SORT WITH THE PERSON WHO FILED THE RESTRAINING ORDER. Failure to do so can and will land you in the calaboose and make you look guilty, even if you are innocent.

Discuss it with your attorney, but if you are innocent, I think it would be in your best interest to find out who the guilty party is, IF you don't already know who they are.

When, or if, you get yourself exonerated, be sure to bring suit to have the restraining order not only rescinded, but expunged from your record.

Sorry to hear this if you were really wrongly accused. If you feel it was wrong, you're first priority should be to show up to court to explain your story. She might not even show up and it'll be dropped.

You can always sue for slander later, but first ask yourself will it be worth the extra days missed from work plus the thousands spent on a lawyer.

I agree with rootzgirl34 my ro isn't as bad as yours . Mind is just no contact order its a easy follow up. All i have to do is to study hard to past undergraduate school and transfer to a better school. So i be safe.

look, this person did not just drive by your house,see you and decide to file charges against you. so ,what ever happened,you need to be honest. if you're innocent, then don't back down. whatever the reason for her doing this, only you and her know.but you better have your stuff together when you go to court. pray she don't have film,or witnesses. and see to it, what ever you didn't do,don't happen again.

You need to find as many witnesses as you can to testify in your defense.Slander has to be proven. Why would this person lie about you and can you prove she is lying/Let a jury decide

there was a hearing before the ro was issued. the judge found there to be enough evidence for the ro to be issued.you never told anyone what your job has to do with all this. it now is starting to sound made up

why would u need to carry a firearm anyway?unless you hunt??? and if you have not done anything then why would u be getting a restraining order against you? stop talkin to the person, lose all contact, move.. sell ur house and move .. if it's not true then get urself out of the situation!
