How do I get a restraining order from the builder who is building a house next door to me, and also shared a driveway, with an ingress and egress from all three properties of subdivision. Builder has repeatedly harassed me, allowed workers to urinate in public on property (pics availble) and blocked me from getting in and out of my proerty on a regular basis. Several police reports available. My property markers have been removed and new ones are in place based on builders survey (not allowed). Builder also fraudulently tried to overbill for unauthorized work on shared apportionment, which remains in lawyers hands, but is unwilling to negotiate. I am at my witts end and want to know at what point is this harassment? Every time I try to contact my local Town of Newburgh, things get worse and I feel trapped. Someone is getting paid off or something is not right. Who do I complaint to, to get things deal with righ? Please help me right the wrong.

Builders usually have strong ties with local government, so it doesn't really help. It is not so much about pay offs, but about people who work closely together. Local government are usually also local business people.

So, what do you do?

You have the right not to be harrassed. So you can take a restraining order out against your neighbour. Obviously they will be permitted to work on their property and use the driveway. But if they do anything else they can be arrested.

Restraining orders are flexible and designed to create a situation where a person can lead a normal life, but not be permitted an opportunity to commit a crime. It is also designed to give the police the power of arrest even when a person is not committing a crime (merely in a position to do so).

Also try using the media. With some bad publicity this guy might find he loses lots of contracts and money.

This begs the question. Why is he calling the law enforcement officers on you and your husband, why is he banging on the partitions, and finally, why is he telling you to circulate to mattress? Does he stay in an residence slightly below you? Are you noisy? Do you reside up previous due, yelling or arguing with one yet another, preserving him wakeful? Is he senile or does he have dementia? Is he bored and basically eager to harass you? From what you have pronounced, no longer something sounds out of place right here. i do no longer think of you could desire to document a restraining order. he's looking you, in all risk in a no longer-so-friendly way, to be quiet. a minimum of that's what i'm getting from what you have pronounced. I even have associates around the line who combat all night long, hear to their music too loud, loud television, and loud voices. i will relate.

Simple - first thing Monday morning call four or five attorneys who work your local superior court and who specialize in Real Estate Law. Hire a lawyer to protect your rights and get this under control.

Have you invited the builder in for a cup of coffee and tried to settle this manner in a friendly manner???This sounds like a large economy sized pissing contest. Good luck,

contact your local police or sheriffs dept. and tell them of your concerns. They can contact the party in question and mediate a solution that will fit both of your needs. If they are urinating on your property that is public indecently and can be a city ordinance violation.

You have to prove he's really causing you harm and to do that get yourself some legal help
