How long does it take for a divorce to be granted when a spouse is missing? It's my boyfriends wife; he hasn't spoken to her since 2005 and doesn't know how to find her.. They were together a month before they separated... He's unsure if perhaps she's already filed for divorce herself yet; we tried to find that out but got the run around at the county offices. This is in Dallas county.. Does anyone know how long it will take to get this processed and filed before the divorce is granted.

Once he meets with his attorney to file, they will first try to have a process server deliver a copy of the request to her last know address. Once that fails, then they will place an ad in the newspaper of her last known town. I am unsure of how long the ad has to run. However; if she does not reply, then the divorce can be granted.
Because he hasn't spoken to her since '05, it is possible to have it either annulled or a divorce granted on the grounds of abandonment (since they were only together for a month.)
I suggest that he consults an attorney (many offer free consultations) so he can at least get a time frame for dissolution in mind.
It can be a couple of months but more than likely 6 months or longer. It just depends on how much info he is able to provide on the ex. They make a honest effort to try and local the ex first.
Also, this type of process is fairly expensive because of the need for both a process server and placing the ad in a paper. It was about $700 for my friend.

He needs to check with an attorney, because the laws vary from state to state on this. Generally what happens is a notice is placed in the local paper of the last known address of the missing spouse. After a certain period--usually determined by law, the spouse is ruled having abandoned the marriage, and the divorce is usually granted rather quickly after that.

Check with your states policy for Spousal Abandonment and Divorce from Bed and Board. It can also be put towards a no fault divorce where a certain amount of time needs to be lapsed before the divorce can be finalized. Do an internet search for your state and county laws and also consult with a lawyer.

uuhhhmmmmmm.........this sounds a little strange to me. Maybe I have seen one too many crime scene shows but I know that if I lost my husband, my world would come to an end and I wouldn't give up until I found something. Surely if she was divorcing him she would have told him something. at least have gotten some kind of paper in the mail or something. I thought that you had to have her signature to get a divorce finalized. Not sure though. Sounds like a very strange story to me. Something is up here. You can look in records to find if she has filed though. They will tell him that.

Now... I always like to answer in a way I get a best answer rating but in this case I have to ask a hard question here:
Has it occurred to you that this woman may have run away from this guy for a reason? She may be living somewhere and have a restraining order out against this guy and he could just be lying.
Or worse:
She could be lying in a shallow grave in the desert.
His whole story sounds a bit strange to me. I think you might want to slow down on this whole deal and see how he reacts. If he starts to get jealous or controlling... you might want to disappear yourself.

I once heard that they had to be gone for at least a couple years and then you could fill for divorce and have it listed in that once section of the paper that they list all the lawsuits.

I have a friend who thought he was divorced, until he applied for a marriage license. he somehow via the shriffs department able to track her down and finally get the divorce and be able to get married.
