I live in Houston texas and i have a protective order from my wife and need advice what to do i already have a
i already have a lawyer and she is lying about the situation I am devastated because i LOVE my 3 sons and i can not see them and can not call either the children she went to the movies with me and the 3 kids 5 days after she file for protective order. and she is lying that i told her i am going to shoot her and attempt to hit her. I will never do that because i know in texas HOUSTon you go automatically to jail. need help i still love my wife and i want to go back home w/ her and the 3 kids CAN SHE DROPPED IT or what can happen. I hope she will feel mercy and think about how much i love her and the 3 sons we have. I am going to qualify this with a couple of things, first I am not a lawyer and secondly laws do vary from state to state. In the state that I live in (North Dakota) even if the victim contacts you she is not in violation of the protection order, you are for allowing her to contact you. The children can testify but the court may turn that against you. It is very risky to put children on the stand. Ultimately it is up to the judge and judge's opinions do vary more so even then the laws from state to state do.

There is no doubt you love your children and they have the right to be with their dad.
Court is not about fairness or justice. Those who are the most prepared, win and in many cases, women have the advantage of friends and family "coaching" them as to how to get what they want; revenge, and the kids pay the price by being in the middle.
You can win, but it takes time and research and being one step ahead of her. From what you say she is a liar and is practicing PAS Parent alienation syndrome. Keeping the kids from their dad on trumped up charges. I would not trust this woman no matter how much you love(d) her- ever.
I take it you were not able to get the order of protection modified? Did you try? Are the children listed? are their schools listed? Do you have supervised visitations? Do you have phone contact with them? Do you have a notebook where you document every contact phone or otherwise? Write down times and dates and a brief description of the even, such as the movie. I can't tell you how important this is. You will forget details the more "games" she plays and summiting evidence in court is important although not the turning point.
Get on-line to you local Father's Rights organizations. Run by fathers in the same situations they are more valuable than lawyers! read and learn your states laws. Go down to the court house and as the clerk of the court what forms to file for modification. Have someone proof your requests to the court so they are spelled correctly and are worded clearly and concisely. Judges are not known for being patient and they deal with the scum of the earth so you need to stand out as a respectable father fighting for his children's rights. See what your town has for father's groups I mean it, these guys know and have been through the worst so they can help you. Get business like and turn off the emotion. You tell your lawyer what to do and hopefully you can begin representing yourself. Many fathers do.

No...once a protection order is in place that is all that matters. They do not give them on a whim. She had to have reason.
In so far as the children go... make it your priority to be the best father possible and that means that no matter how difficult it is....do NOT say anything bad about their Mother...it will be very hard but well worth it when they are grown up
Remember, they are only children for a short time...once they are adults, they will be adults for the rest of their lives...it is then that they will appreciate the way you handeled yourself..and that is what matters now....
