Unfortunately this probably isnt the answer you want but this will be the legal one. The only way for you to obtain custody would be to have mom ruled unfit to have custody. This is usually done by the way of legal charges o pending charges of child and/or drug/mental abuse. Unless she is ruled unfit you wont stand a chnace in hell. There has to be cncrete evidenceof such chages and not hearsay for the court to rule on. Not easy especially since they are living with mom already. Once and if you can get mom ruled unfit then you have to convince the Judge that youre the best choice for the kids to live with. Not easy again but easier than having mom ruled unfit. So your best bet is to be really sure this is what you want. You can always take he back to court for a remodification hearing for custody on down the road. One idea would be to ask the Judge to let your sons decide who they want to live with. This may work if mom agrees and the Judge honors the request. Worth the try. Good luck

Get an attorney. Period. It is difficult for men to obtain custody of their children. You need to ensure that there is sufficient room in your home, i.e bedrooms to accomodate the children. You need a stable job, to prove that you can provide for them. And it wouldn't hurt to have the kids on your side. If they are old enough then they can decide where they want to stay. Get an attorney, read up on custody laws by following the links below. Good Luck!!

Well being the mother of a social worker i can tell you that is going to be hard to do unless she is willing for you to have full custody or she is so unfit then the judge might rule in your favor providing you have a clean background.

Their mom would have to be declared unfit for you to get full custody. Sorry, but that's the way it is in most states. Best to consult a lawyer on this one.

to get full custody you'll need two things: a good lawyer and proof that she is a unfit mother and a danger to the children.

Good luck

Get a lawyer. And you need Definite proof that they are better off with you. Give reasons. And make sure the judge knows your children aren't brainwashed.

sorry to tell you but the children usually end up with their mother in custody battles, she being the one who had them come out of her womb. but if you can, try to get them on weekends. it also depends on the reason of the divorce, they tend to be nicer if its not your fault ya know :D

First and most important step?
Get a 'cut-throat attorney . . . one who literally goes for the jugular. One like that? will have a reputation that precedes them, and should not be hard to locate. . .
Good luck.
