My mom has a will and i am excutrix. Mom is still living but in a Rehab center, She suffered from a ischemic stroke on March 26th 2007. I need access to her banking to pay bills and to make medical decisions for her due to not able to communicate with the doctors. She is unable to understand or sign her name either. If some one can help I would GREATLY appreciate it!!! Thanks :o)

You need to seek the help of a Lawyer who will liase with the medical staff about your Mothers condition.

You may have to go through the courts but the sooner you get started the better.

Sorry to break it to you...you cannot set up a Power of Attorney, ordinary or enduring, if the principle is unable to sign their name already. Sorry.

You may have to contact a lawyer to try and set up another arrangement.

Did your mom have a presigned power of attorney or living will?

If not you will have to the court to appoint you are guardian. See a lawyer.

Also talk to the social worker or patient advocate at the hospital she is in.
