we ended up going anyway before I even read the answers. we were in luck because our cemetary does not close. it was a very interesting experience.
redvelvet: i love how you can make assumptions about someone (whom you've never met) and their amount of expertise, miles away. you really made yourself look like an @$$. just thought you'd like to know.
a couple other people mentioned something about traipsing around on peoples' graves and defiling headstones, leaving beer bottles, etc. I was a little insulted that people would assume that I would disrespect the passed and their loved ones. but in any case, I don't drink (no ghost hunter should, right?), we stayed completely on the gravel path (hence no traipsing), and I'd never even contemplate defiling someone's final resting place.

If you were caught, you might be charged with trespassing or even breaking and entering. It would depend upon the laws in your area.

You would be subject to arrest for breaking and entering, trespassing, and the like. Please do not venture into any cemetery after it is closed. I know that the prospect sounds exciting (and I've done it, but the local police department was alerted before-hand and I had the proper documentation and certification needed to do this).
Please think of how you would feel if it were your loved ones buried in there and someone else was walking over their graves and disturbing the cemetery. Alot of people, unfortunately, go into cemeteries at night and destroy gravestones, defile graves, etc.
Have a lovely rest of the evening.

It's a misdemeanor and the fine is $35 for the first offense--trespassing. If any stones have been damaged, any beer cans lying around, or anything added to a grave (such as paint, funny signs, used condoms, or something novel like a plastic skeleton) that will be determined to be your doing and the fine will escalate to $180. Please, if you must ghost hunt, do it with a group and okay it with the cemetery personnel first.

Depends on the city/town where you live. I have been caught at several cemeteries and haunted houses and usually I just got a talking to and kicked out. After I turned 18 I was a lot more careful and have not been caught since then.

i love going to cemeterys at night. ive never had anything bad come of it. we did get caught once (me and my friends) but they just told us we weren't allowed to be there and told us to go home. id say that if you go out and and dont take any flashlights , aren't loud, and respect the area it should be fine. if you are really worried about getting caught go to a grave yard that isn't that public. one that is just kind of tucked away from the world. those are my favorites.

Depends on whether the cops or the ghost catches you! Which would you prefer?

Definitely what Emmapeel said, but do you have any idea what you are messing with and the consequences? Unlikely. Even the most experienced psychics as my lineage avoid the cemetaries after closing hours. I personally avoid them period. Freakin' walk out of there with some bad entity attached to you and then you have to clean yourself.....
