Domestic abuse...you can't get the charge dropped. If it's your boyfriend or husband, then the judge will automatically deem your testimony biased, or your intent to drop the charges due to co-dependency, intimidation...fear of making a go on your own...

Assault, by a friend, sometimes the police and the judge allow you to make the call. Unknown assailant, they might pursue the charges anyway if they have enough proof, just to get the person off the street.

If it is your word against the other person and there is no other evidence, then yes, the assault charge can be dropped. However, if there is evidence of injury, the state makes the charge, not the victim. If the victim lied, then the state can charge the 'victim' with filing false police reports,etc.

not anymore, if it was absolutely clear to the police who arrested the person that they did assault you, then the DA for whatever state you are in will persue it regardless if you want to drop the charges are not. If it's kind of questionionable, then you may be able to. If it's against a domestic partner, then it will be tough, because again, it's up to the DA what they want to do. Good luck. p.s. if it's against your domestic partner, I wouldn't drop the charges because you can't let people get away with that kind of crap.

Only the DA can drop the charges. Even if the person who was abused doesn't want to pursue the charges the government can proceed since a crime has been committed.

nowadays most states will press charges for assault making the person that got assaulted unable to have any say
