of 21 to be present at a underage drinking party? This person present is not consuming ANY alcohol; I am just wondering if a witness to the party can get into trouble.

I am 18 years old.

It does not appear to be that way. I researched the Illinois Liquor Commission website. http://www2.state.il.us/lcc/under21/Under21Laws.pdf

If it can be alleged that you were in possession of the alcohol, either opened or unopened, it is a punishable offense. $500 fine or 6 months jail term.

If you are caught underage drinking, it is a fine of up to $2,500 or a jail term of up to a year.

If a parent furnishes alcohol to a minor or hosts a party at which alcohol is consumed, it is a Class A misdemeanor punishable by a minimum $500 fine up to a maximum fine of $2,500 and a jail sentence of up to a year. http://www2.state.il.us/lcc/under21/JustFactsWeb.pdf

I do not know for SURE, but from what I have heard (I'm 18 too) is that yes, you would probably get busted for being there, as there are minors with alcohol. Best idea is to just not drink altogether

As long as you are not in possession of an alcoholic beverage when the party gets raided, and you request a blood test to prove your innocence, you should be alright !
