If you go to the store, they normally have a tester "Try me!" product for you totest, and then the product for sale behind it. If you were to leave the store with thetester, would that be considered shoplifting? Technically, it is a free sample......

Yes, to remove anything from a store without paying is shoplifting. You test in the store only.

Did you seriously even have to ask that? It is not a free sample. The only reason it says tester on it is so that people don't start tearing open every package and spraying it on themselves. The store paid for the tester just like it paid for all the other bottles! I work in loss prevention and I've caught so many people stealing testers it's not even funny! It's merchandise, just like the clothes, food, or whatever else is in the store. If you pick it up, pass all the registers and exit without paying for it, you're stealing it. Any court will tell you that and any judge will sentence you for it. By the way, it doesn't even matter if it has a barcode on it or not. If the store can prove you stole it (my job along with dozens of cameras) then you shoplifted. If you walk into the store and leave without paying for it, it's shoplifting. I can't believe you had to ask that. If you steal spoons or forks from the store deli, its shoplifting. It belongs to the store, you stole it, you're busted.

now it depends on what you are talking about.
Of course it isnt shoplifting to take a food sample out the door.
But if the sample is meant to be used over and over for multiple people, like a fragrance bottle, then you would be stealing.
They wouldn't want you to take the whole tray of little sample cheeses. Just one.
Now here's the way around it.
Bring a container that you can transfer multiple samples worth into. And say you are bringing it to a disabled friend.

yes as a store detective I know it is still considered shoplifting the product is considered to be used in the store as a tester not for the customer or employee to just leave with it

If you walk out with the bottle, it is theft. Even though it is not for sale, it is the property of the store. Spray all you want, douse a kleenex, and rub it on later, but the moment you walk out with the bottle, you are a thief. Ask the sales gal for a sealed sample, sometimes they have them in upscale stores, but they don't leave them out in view for the obvious reasons

I think it would be considered shop lifting. Everybody pretty much understands it is the store's property and they are letting people have a test sample of the product--thats why its there, its not provided so that people can take it home.

the only way it would not be shoplifting is if the store actually handed it to you and said heres a free sample you may take it with you

yes, i would, and have busted people for taking the testers. you know its not yours and that it is for a trial.
be prepared to be stopped if you take it. although now we keep ours behind the counter. and actually it works out for the better, because the girls i busted admitted to taking the testers, because they 'thought ' they were free. makes my job easier because i don't need to have a nice long interrogation while the cops show up to get you to admit to it.
what they don't know is me and my partner were behind them the whole time listening to what they said and they used the word steal quite a few times.

Most retailers forbid LP from making stops on testers. a "tester" lose sits value once opened therefore the store already willingly sacrificed its profit on that item. If you need more info on shoplifting try this site
