Sister got into drugs her house was reposessed and every thing was put in to storage and was never retreived, every thing lost. I called son of person who sold house to parents in 1962, he has no idea about it. Deed was never recorded .Person who sold house to parents passed away.Back when my parents bought house they had a contract with the owner, the house was payed off in 1984,Then it was homesteaded. How do I get deed.

First, you need to probate your parents' estates if that was not already done. You will also have to file a "quiet title" action in the courts. A quiet title action basically asks the judge to issue a court order determining who the rightful owners of the property are. This is not something you can do on your own. You will have to hire an attorney. You can find a local attonrey at www.martindale.com.

You should start at the county courthouse to see if #1 who legally owns the property, and #2 if your parents had a will. The Will will govern how the property is disbursed. If there is not a Will, it most likely will be taken by the state into probate. Once all debts are satisfied by monies in the estate, the house will most likely be granting to the survivor in the family. If more than one, the state could force a sale and the proceeds be divided. You may also need to retain an attorney,one who is experienced in estates. It could be a long process, so be ready to put in the time.

If your sister had it forclosed due to failure to pay the taxes, you buy it from the tax man.

If your sister had it mortgaged to the hilt and the bank repossesed it, find-out which bank and offer to buy it at a fair portion of market value. Since banks tend to only see pennies to the dollar when selling forclosed properties, they may go for it.

If your sister had it seized by the cops/feds as part of a drug arrest, you'll have to wait until they start selling off seized properties. In either case, you can ask to be placed on the "mailing" list for when the properties start going.

As for accessing the deed...contact the City/County/State Land Registery Office. They should have paper on the disposition of the property from it's original purchase up to it's most recent disposition.

All that being said, there is, honestly little chance you can bring the property back into the family, but there is a chance. I honestly wish you the best, and hope that you can do it. Do not become discouraged, and keep the faith. You could beat the odds!

Try your local court house... most property deeds are there for tax purposes. Explain what has happened, most office people love "mystery hunts" such as this ;)
Did your parents have a lawyer? check with them...
Try to find utility bills to establish residency...look at local property website for the area if available, mine is listed on our county website... Good luck
