Monday night at 11pm i asked my neighbor's sons (age 18 and 19) to turn down there music. They were underage drinking and one of the sons spit in my face. I turned around to go to ask their mother to have them turn it down. As i headed in the direction of my home the son assalted me from behind by tackling. Recieved minor injuries from this. I called the police. I told the police what happened and informed the officer that the sons made threat of damaging my property in my yard.
I woke up this morning to all my yard stuff either damaged or missing.
On my deck i had about $80 worth of plants and along side in pots i had about $20 worth of tomatos and other vegs. Then in my front yard i had a fenced in garden with about $100 worth of plants and about $300 worth of time and investment lost. They started a fire and burned my lawn chairs. The kids are not on the lease and mother says she has no responibility for them. What can i do? Can i sue mother? I live in Oregon.

I have talked with police and they said in civil court there only needs to be some evidence unlike a criminal case which as to be without reasonable doubt. Also when i called the cops i think they over heard me because my father in law saw them come out and climb over the fence in there yard. Their front enterance for their place they have to come along side my yard and the fence they climb over to run leads into some wooded area. So they are definelty the one's who did it.

I would start by filing a police report. If the police prosecute and there is a conviction, the judge will order restitution. You don't pay a prosecuting attorney. You would, however, have to pay an attorney to represent you in a civil lawsuit.
I think you would have a cause of action at least for assault and battery. It may be hard to prove vandalism unless there were either a witness or the cops were able to get a confession from one of them.
I would only sue if there were no criminal prosecution.

Call the cops (again)! They should've arrested the mother for assault and procuring for minors when you called them the first time. You'll most likely have to sue the kids for the damages since they are over 18, and be sure you have witnesses to make the charges stick, otherwise, it's just your word against theirs. I'd include the mom's name in the suit to make her testify under oath cuz if she lies, it's perjury and punishable if you can prove it. Don't get your hopes up though, because it seems that often these days, the law works more for the criminals than the victims. Good Luck!
(When all else fails, there's always legal methods to pay her back for what was done.)

Yes you certainly can. You should also call the police and let them see the damage. Since you told them that the boys threatened to damage your yard they may arrest them on probable cause. Since you seem to be able to afford so many plants I would also invest in a security system that includes video taping of your property because they seem like the kind that would seek revenge when you do sue them Don't let that stop you.

Yes, you can sue them for anything they did to your property as long as the dollar value is above $20. You could also get them in major trouble for the underage drinking and the assault.

Get a gun, turn your cameras off, capture them on your backyard and shoot them. Say it replaced into self protection and you're sturdy to pass....do not likely do this, you're able to have a clean living house with a room mate called Bubba. purely touch police to come back accessible and tell them what happens. If that would not do something, repeat it returned and returned til they do something, believe me, they are going to do something.
