That depends on lots of factors. First, make absolutely certain that your employer has paid for the workers comp insurance. It's against the law in the US for a company NOT to pay, but I've heard of a few companies not paying. If they don't pay, you can't get workers comp ... you'll have to sue the employer.

Hire a lawyer. That's what I had to do when I was injured on the job. They didn't want to pay, so, I sued them. Good luck.
