The only witnesses were friends of these people, who went to "run an errand" instead of accompnaying my child back home to make sure he was okay (he's five). They did call the police, however, while I was busy rushing my son to ER, and made sure to tell them a completely skewed version of the events (the police actually told me I was lucky they decided not to press charges for vandalism--this while the doctor is pulling loose teeth out of my son's mouth).
Ordinarily I would say, oh, well, accidents happen--but it really, really bothers me that they just didn't care that they had hurt a small child; didn't bother to tell me what happened, just took off to the liquor store like it was nothing. This is not okay, and I feel that the least they can do is pay for this fun little visit to ER, which is going to run into several hundred, even with insurance.

Where were you when all this was occuring? A 5 year old should never have been left unattended outside without adult supervision riding his bike in the first place. Be thankful the police didn't charge you for neglecting your child or child endangerment.
If your child crashed his bike to into their car, their insurance is not liable for your son's medical bills, you are and you are also legally liable to any and all damages to their vehicle.
I feel bad for your poor child, but the it was completely avoidable had he been properly supervised, which is your responsibility.

Why was the car moving with the door open? I don't know if the insurance company has to pay for stupidity! Don't you realize YOU are responsible for everyone in your car and everything that happens when you are driving? If the door was open you should not have been driving!!! I don't know if your insurance will cover you being neglectful, he may have to sue you directly for the medical bills!!! then you will be dropped by your insurance company!!!

I am afraid based on the police comments and witnesses comments that your son has been assigned blame for the accident. Just like cars on the road, bikers have to follow the laws and rules of driving. If the accident is your son's fault, its your responsibility to pay for his care, not theirs. Also, if your son damaged their car, you will be responsible for that as well. It is disturbing that the people were not more concerned about your son, but also that they were not charged for leaving the scene of an accident. But unfortunately, because you were not there, and your child is of young age, the only words to go on are the witnesses. Sadly it is not a nice world anymore- its best not to let the kids ride their bikes unsupervised, at least not until they are much older and can be more accoutable for themselves.

If it was the child's fault, unfortunately, they are not responsible for any medical bills.
If, however, they were at fault, then YES, they most definitely are responsible.
Either way, I do agree with you that the should have said I hope the boy is okay.
These people sound like real jerks.
Don't deal with them unless you have to
And by the way, I hope your son is fine....I feel sorry for him...he is only 5, and I know he did not mean to run into their car....

Where were you while your five year old was riding his bicycle on the street? Sounds like you care as much as the person that he crashed in to, and that you aren't worried about anything but the hospital bills.

Not if it was your son's fault. The insurance company has to investigate and find out whether the driver could have avoided the crash. I am sorry to hear about your son and do hope he recovers well. Who was supposed to be watching him?

They are not liable.Your child hit the car not the other way around.I am sorry.You maybe liable for any damages mad to the car.

you'll be lucky if you don't get sued for damages. why was your five year old unsupervised anyway? you in the habit of letting a five year old ride a bike around on city streets? unsupervised? are you insane?
