report to the police as it is stealing, then go to the small claims court, it doesn't cost a lot, also go to your local citizens advice office, they will help you too, hope you get your money back, all the best

Hi there. If that is his undisputed property and he can prove it, and you're in either England or Wales, she has very probably committed theft under Theft Act 1968.

That she doesn't still have the property is irrelevant, it wasn't hers to dispose of - the Theft Act is broad enough to encompass such acts - in this instance it would largely revolve around the intention to permanently deprive him of his camera by selling it without his permission.

Call the police, make a complaint and get it investigated if you are intent on doing it the official way. IF what you have reported is what happened and there is no dispute over ownership, then you are well within your rights to seek a remedy under criminal law.

If it is not that straightforward, you can pursue a case in the county court under civil law. However, if I were you, I'd seek the criminal route first, if the law has to be involved at all.

Whatever you do, don't get involved in tit-for-tat behaviour and if you do go to the police, cease contact with this person ASAP. Antagonism and inconsistency will not do any potential investigation any good.

Good luck - hope it gets sorted.

Your brother will need to prove that he bought the said items with the bill of sale or credit card statements. I watched a bailiff program on T.V where two guys shared a house, and one of the guys got into a lot of debt with credit cards, but the other guy always paid his way and had some nice stuff. However when the bailiff came they took everything, leaving the guy that wasn't at fault to prove that the goods belonged to him with receipts and card statements before his stuff went to auction.

You should go to a lawyer but I wouldn't steal their stuff because then you could get arrested or you might not get as much money as you would've.

First - call the police and file a report.
Second - go to court.

**If you go to court and have not filed a report with the police ASAP - it will absolutely hurt your case**
