The federal minimum wage for covered, nonexempt employees is $5.15 per hour. The federal minimum wage provisions are contained in the Fair Labor Standards Act (FLSA). Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.
The FLSA does not provide wage payment or collection procedures for an employee's usual or promised wages or commissions in excess of those required by the FLSA. However, some states do have laws under which such claims (sometimes including fringe benefits) may be filed.
The Department of Labor’s Wage and Hour Division administers and enforces the federal minimum wage law.

In California the State minimum wage is $7.50 an hour, although San Francisco has mandated all employess be paid a minimum of $9.14 an hour.
Beginning January 1, 2007 and ending December 31, 2007, all San Francisco employers must pay to each employee who performs work in the City (including temporary
and part-time employees) wages not less than $9.14 per hour.
The minimum wage requirement, set forth in the San Francisco Minimum Wage Ordinance, Chapter 12R of the
San Francisco Administrative Code, applies to adult and minor employees who work two (2) or more hours per week.

It actually can vary from $5.15 and up. Several states voted on raising the minimum wage. Here it is $6.25, other states have different rates. If yours wasn't one of those states, then the minimum is $5.15.
sorry

NOW there is an exception... some restaraunts pay LESS than that per hour to waiters and waitresses... something like 2.50... because they get TIPS that compensate..

6.50 is legal since the minimum wage is currently 5.15. As for JC Pennies, I worked there in 1996 for, you guessed it, 6.50. That was by far the worst experience of my life as far as jobs. I have gay friends, so I have no problems with homosexuals, but my gay manager went overboard with the sexual harassment, embarrassing me in front of our Levi Strauss rep's who came to setup their display, my making inappropriate sexual innuendo. Making derogatory remarks that had them asking me if he normaly did that to his employees. Unfortunately I was the only one, so when I tried to report it to HR, I was blown off and told that I was being "non-tolerant" of homosexuals. I also had problems with pay and schedules. I could go on and on but I think you get the picure.
