You need to contact your city's building inspector and make a complaint. They can have the work stopped before any more damage is done. This contractor will not stop encroaching on your property unless he is forced to. He has NO reason to be on your property without your consent any way. The company I work for never crosses or uses a neighbor's property with expressed written consent of that owner. AND we always return that property to its original condition if not better. Having bad feelings among neighbors over a sloppy contractor is not good. And is poor business for contractor.
As for the boundary markers, most cities are now requiring that all boundary markers be located before construction begins to Prevent someone from building too close to the property lines. Again check at the court house for that information. Your neighbor and their contractor are probably in violation of code. You may be able to get damages from them.

Permits to do the work should have been obtained. Check with the permit office. The old holes for the fence should still be there so look for them and mark them with paint. many property lines are marked with a concrete stake at the corners of the property that is at a level position with the dirt. See if you can find them on the side the construction is taking place.

I guess you need to get out there now and look for evidence of where the fence was, measure it from a fixed point ( house wall eg ) and photo it.
I wouldn't wait for the extension to be built, that too confrontational and you'll end up paying to go to court. I would point it out before hand, and if they still carry on, hand them a letter saying you've pointed this out and will seek remedial actino to restore your property.
It is trespass, for which you can get the police to have a word or take out an injuction ( which will cost you about £1K )

If you are sure that they have gone over the boundary line then you need to take legal action to stop the work. It could be that that they have built right up to the boundary line, and if this is the case they can have nothing hanging over at all, this will include barge or fascia boards and of course guttering.

Refer to your title deeds, there should be a diagram showing boundaries.
Although technically they are wrong to take any of your garden, you need to decide if it is worth the hassle (and cost) of persuing in a legal sense.
If we're talking a couple of inches, maybe not. Any more, and I'd approach them and have a polite word.
If their building work is significant, they should have to have planning permission, which should include detailed plans, you can probably view these at your town hall. If they deviate from these, the council should help you solve it.

If you own your home, the plot specifications (measurements) will be stated in your home ownership papers. Use them to check the boundarys of your plot of land. If you rent, contact your landlord at once! Under no circumstances let them replace the fence till you are satisfied with the measurements. If you accept their fence, you've accepted their measurements.

I think you can contact the county & have them check the boundary lines. Since you pay taxes on specific sized piece of property , they should have the records.
