I lost my children to child protection services in 2000...in 2002 my wife died...SHE SIGNED HER PARENTAL RIGHTS AWAY BY MISTAKE...THEN I WAS TRICKED into signing MY parental rights away...my children werew ADOPTED SWIFTLY BY THE COURTS...before I had a chance to fight them...I WOULD LIKE TO TRY TO GET THEM BACK...WHAT CAN I DO? IF I can't get them back...who can I talk to about the PAIN OF LOOSING THEM?

Even if you were tricked into signing your rights away, the courts would look at WHY your kids were in CPS custody anyway. The law in several states is that if they spend 15 of 22 months in state custody your rights are automatically terminated.

Start by talking to an attorney and see what your options are. They may not be many at this point in time. Second you need to seek counseling. Your local mental health facility should help you, if you cant afford that find a clergy member you feel comfortable with. I am sure the pain of loosing your children has been terrible. But your kids have been in the system for 7 years. They have spent that time adapting to the changes in their lives and eventually to new homes. To disrupt their life now would be very painful for THEM. And if you love your kids, their happiness should be more important.

Unfortunately, in Family Law, once you sign away your legal parental rights, the children are no longer considered your kids. They are now wards of the state and can be adopted by others. The only way you can get them back is to hire a lawyer and argue that you signed your parental rights away through fraud, duress, coercion, etc. I just want you to know though that these are pretty hard to prove.

Second, if your kids have been adopted already, that will make it harder. The courts use a "best interests of the child" standard, and generally will not take an adoptive child away from their adoptive parents if they have created a bond and the child is happy and secure because it would not be good for the emotional well-being of the child.

If you do decide you want to go ahead with this, contact a Family Law attorney who can attempt to argue that you signed your parental rights away under duress and that it would be in the best interests of your children to be with the father. Good luck!

Well I was a foster child in the same situation and I think you should fight to get them back but you need to talk to them first and see what they want because sometimes you have to think of your kids happiness before your own

Go speak to an attorney about this. There are plenty of attorneys in your area who can help you. Also, go see a counselor. For your own good. If you can't afford a professional, then I suggest you go to your nearest churches. Many priests are trained in counseling services and offer them for free. Both the Catholics and Mormons are extremely good about this.
