My husband's Stepson (from his previous marriage) uses Stepdad's surname but was never officially changed from birth certificate.. He is going to be getting his licence at the end of the year - which surname will he have to use? the one on his birth certificate? or my husband's one, the one he has been using for school and medical purposes all his life?

He will have to use the name written on his birth-certificate.

It is possible for him to change his name though, to do this you need to contact the Birth,Deaths and Marriages department in your state. It's as simple as filling out a form and paying a fee.

He will have to use the name on his birth certificate as that is his legal name. He can change his name now that he is over 16, and can do this by "Deed Poll". I am not sure of the correct procedure.
If he was under 16 then his name can be changed by your husband adopting him, or by him changing his name with his real parents approval.

Your husbands stepson will have to use the name on the birth certificate. He can have the birth certicate legally changed. Or if your husband legally adopts him - then he may use his stepfathers surname.

My daughter had the same problem the easiest way is to change your name by deed pol as the the man above me has said and if he is not 18 he has to get his legal guardian to do it and it costs around $100.Then he can still have all his medical and school reports in the same name and it is his legal name.This way when he needs identification for certain things like his 18 plus card in the future he will find it so much easier.
