Yes it does and the president did not until 1960's when the congress voted to allow the president to on do whatever he wants to do to protect the country from the Russians. Since then, the president kind of has that power as well.

Section 8, Item 11 of the U.S. Constitution specifically says that Congress has the power to "declare war, grant letters of marque and reprisal, and make rules concerning captures on land and water."
Obviously, George W. Bush - among other Presidents - seems to believe that he is above the law of our land.

yes. They're the ones to decide whether our country should go to war, therefore the president doesn't have the power to do such an ultimatum.
