J.K. Rowling has been asked that before I've seen it either on her website or on a different fan site but I know she has answered it because I always wondered the same thing. She said that House Elfs are different than wizards they're powers are completely different so what they do isn't technically considered apparation. They actually have a lot of power its just that they don't really use it.

Whoa!! good observation!! I didn't ever catch that and thats something you should write to Rowling about!! I suppose it leaves open the possibility that it isn't EXACTLY apparating that the elves are doing perhaps just something else BECAUSE house elves can only do minor magic as said in the book, and seeing how you can only learn apparation in 6th year, that would seemingly be fairly advanced magic right?? If so then no house elf should be able to do that. cant wait for the 7th book!! see ya

I believe that elves don't Apparate becuase they use their own special magic-- So, they don't have wands to Apparate with, which may be why they make a popping noise when they enter. Each wizard has a different sound when they Apparate/Disapparate, so pay attention to that. :3
JKR may have left clues in the series about that, but don't quote me on that. We have yet to understand what powers elves specifically have, and JKR has yet to explain herself.
But, back to your question, you could say that they can do things that wizards cannot. But it's no loophole, that's for sure.

I think they can for two reasons:
Even though you are correct in saying they are apparating, I think they can because they aren't human. An awful lot of house-elves work in the kitchens and around the castle, and they're so small I'd imagine it'd be hard to get around without apparating. And my second reason is that it's canon and we can't do anything about it. if you want more info, I suggest checking mugglenet.com, hp-lexicon.org, or leakynews.com. I never thought about that. I also have a question if anyone wants to help me out. In the fourth book Harry sees Voldemort and Dumbledore uses a truth potion to make sure he is telling the truth. Why don't they just do that in front of an audience so they believe him?

House elves have their own type of magic and so boundaries that stop human magic don't stop the house elves, at least in this case.

House elvese have special powers to aperate wherever they please because they can not be called wizards they do not have to follow wizarding laws.
