I think it should be banned in restaurants, and places where kids activities are held, ie little league fields, basketball courts, playgrounds.

Smoking should be illegal, because its creating a second class citizen. People that smoke are forced to work in non smoking buildings made for non smoking workers. The surgeon general declared it a health hazard and its clearly marked on the pack, yet the government refuses to classify Nicotine a bad substance .and makes a profit on taxes to help support the non smoking community. On the other hand my brother was run over by a drunk driver, so how many people out there has had a family member killed by a smoking driver, or is it equal or does all the chemical plants have a little something to do with all these deaths, and all that fuel we burn I bet that's good for us to in the long run too. Its not just second hand smoke. Oh that's a good way of showing that health related problems are going down. Suckers
I smoke and I think the government should band it, but they will not, why to much money involved. The states that what to keep the settlement money are doing these things to satisfy the settlement or they will have to pay the money back, again suckers.

It should be legal, but now that we know the smoke effects more than just the smoker there should be restrictions on where you can smoke. When people want something they should be able to get it, music, video games, guns, sex, drugs, any thing. the amount a corporation can pay a lobbyists to make up laws that help them push a certain product or destroy another because it offers competition should not be what dictates what is legal and what is not.

I think it should be legal... I understand that 2nd hand smoke kills... but so do people who are addicted and can't smoke because it's illegal to do so... I live with a smoker and I'd rather have them calm cool and collected than angry and violent... And if they make smoking illegal... then where are they going to get the tax money from??? they're gonna start taxing things that don't need to be taxed as bad as they've taxed cigarettes.

Definetly Legal, it is a matter of choice not a matter of health, an individual can decide that for themselves they don't need a "Nanny Government" to tell them what to do. As for people who complain about second hand smoke, is it not freedom that should have precedence over your comfort. If you hate smoke that much avoid smokers in public by taking a different route when walking somewhere where smokers are, or hold your breath or stop being pụssies about it and just tolerate the smoke for 2 seconds while you walk past.
And the argument that smoking should be banned by restaurants and bars is rediculous. Just as private individuals have the right to dictate whether visitors or guests may smoke in their livingroom or car, so too do the owners of bars or restaurants, who should have the right to determine whether smoking should or should not be permitted on their premises. Some people may prefer that a particular bar or restaurant is non-smoking, others may prefer that it is smoking, but the rules of these private businesses should be made by the businesses owner.

Many of us may not like smoky environments, and we may not like them for a number of reasons. But NO ONE forces us into these venues.

If there is a demand for smoke-free venues, then business owners will make them smoke-free to attract more clientele. You have to think about venues who cater primarily to smokers by making such legislature these businesses may fail.

The government does not need to be involved in this process.

Also some people may not wish to work in smoky environments, but NO ONE is forced to do so. Many people accept risk in their jobs - police officers, construction workers and miners just to name a few. They accept the risks for their own reasons, just like those who accept the risks from second hand smoke when accepting a certain job. it is not like you can't negotiate with the owner on the issue of smoking at the premises because ultimetly you are free to do so.

By making smoking illegal you are regulating freedoms, you are limiting our liberties. In my opinion the freedom to smoke far out weighs my comfort. No one is forcing people to hang around with smokers, so just walk away and stop trying to legislate your beliefs, because often when people say there should be a law there almost always shouldn't be.

Smoking should definitely be legal.
It is a personal choice, not a government choice.
Yes some will argue that it affects the user's health and thats not right blah blah blah. But drinking pop is unhealthy, eating at mcdonalds is unhealthy, but no one has the right to say to you that you can't eat there. Besides, the theory of second hand smoke is a very shaky one.

Legal! I am a non-smoker, but I still appreciate my freedom to make that decision. Establishment owners should have the right to ban it if they so choose, but an individual should be able to choose for themselves.

We, as a society, understand what the risks of smoking are. If you don't, then you choose to be ignorant. We should be allowed, as Americans, to make informed decisions for ourselves!! I don't want our government taking away that freedom. That is what our soldiers are fighting for, our freedom, right??

Legal in private, regulated in enclosed publics spaces where it could annoy non-smokers, taxed to help pay for the treatment of long-time smokers who end up sucking money out of medicare. But, definitely legal.

marijuana should be legal as well but i assume you were not talking about that.

freedom is the name of the game. I won't live forever so let me enjoy myself for my short time on this earth. (of course that wasn't directed at you just how i feel about things)

It should be illegal in public places because it is very dangerous for non-smokers. Some people do not care about themselves so we need the law to stop them from caring less about us. If they do not care about what smoke will do to their lungs, do you think that they are going to care about us?

Smoking will never be totally illegal. The federal and state gvernments make too much money off tobacco in taxes. They may try to regulate where you can smoke, but they will never oultaw it.
