Me and my husband are divorcing and I am from California and plan on returning there. He is from Canada and he plans on staying in Canada. How can we share our daughter (3 years old) through the year? I don't think it's possible. He said he will fight for full custody and now I am afraid of losing her. I don't think you can have a child in 2 different school systems thoughout a school year. I am afraid that it is also too hard on the child. Someone will probably have to have full custody. I want her for the school year but he won't budge. Any advice?

No under the situation you describe the child will be assigned to the residential custodian parent and will go to school there with visiting the other parent durng summer vacation or the holidays only. I take it that the divorce was filed in Canada since the residency requirements were met there and not in Califoprnia which raises quite a dilema. Youre going to need written permission from either the father and/or Canadian courts to remove the child from there if you get custody or possibly both and that may not be easy. Canada may not award you custody since youve made your intentions of moving known and their courts may not want to uproot the child to another country and since they cannot enforce their divorce laws. You may have to rethink your moving plans for the sake of your child, but either way the child attends school in Canada or California but not both and visits the other during the summer. The courts will rule in the best interest of the child first and foemost above you two. Good luck

Best thing for you to do is check into the Canada Family Law rules. But I would guess that since your daughter is only three years old, the mother would get temporary residential custody of the child.

I wouldn't want 2 school systems like that, to hard on the kid. There are free digital online schools, which my kids are doing. try this:

It's still public schools, and it's free. They supply the computers, printers, scanners. All you oay for is ink, paper, pencils, and internet. This is true, no gimmick. I have 2 kids doing it because of the school violence nowadays and because if half-azzed teachers. It's great.

im not sure about now but i went to school with a girl who lived with each parent for 6 months.so for the first 6 months she went to my school and the last 6 months she went to school where her mom lived.so i would call a school and see what they say.good luck!

You need a lawyer. Just because he wants her, doesn't mean he'll get her. Fight for primary custody.

Looks like neither of you puts your child's interest first and only think for yourself. One party has to sacrifice. The real victim is the innocent kid. Shame on both of you
