i moved into my rented house in decemeber.
it seems that the people who lived here before have got themselves into alot of debt, i have debt collectors ringing nearly 3 times a day.
reminders coming through the door everyday.
and a hotel invoice from march and april, they had given this address as though they still lived here!
ive told my landlord and he said it will be sorted but nothing has changed.
ive just received a card through the door saying someone will be calling today, im guessing form a debt collectors so i phoned the number and explained, they were fine and no-one is coming. but my question is, because all of these debts are under this address can people be sent here to take away things from my house?
alot of the debt collectors ive spoken to on the phone dont seem to believe that im not this person, its highly infuriating as i try my best to not get myself in to owing so much money, i dont want to be seen like that. any suggestions as to what i can do?

No, they can not come to your residence and take anything you own since ownership must be prove prior to a seizure. Additionally, the landlord would have to let them enter the premises but only under warrant. Unless the police come calling I wouldn't worry about a thing.

Also I would contact your phone service provider and have the number changed to prevent further harassment. Don't speak with the collectors any further. They get paid to collect funds (even if it is not right or lawful) and by returning calls you are encouraging them to harass you for your money. Either hang up on them immediately, don't answer the call, and don't use an answering series since they can leave a message. Instead just return missed calls to those numbers you know.

As a final resource, you can tell the collectors that they have reached the wrong party at this phone number, any further calls will need to be directed toward your attorney, and charges are currently being placed for any collectors who call after this warning regardless of conditions.

This will make them stop calling.

unless some how the debt is put to your name anyone who enters your residence is to remove anything from your home will be charged with 1st degree criminal trespassing , breaking and entering, and harassment. Just because the preciously tenant moved does not mean that the debt is left behind. If the verbal harassment or written continues. get the person name remove from the postal box. If just continues inform the local law enforcement if this still continues go to a lawyer about how your home is being turn into a hostile environment

you have no liability whatsoever for noone else's debts.
Inform debt collectors that you are not who their looking for and threaten them with further legal action if they insist on annoying you.
The things of the house whether some belong to you or to your landlord cannot be taken away for no reason. If the previous tenants left any of their posssesions then pass them over to your landlord.
If in any case they keep on hastling you regarding debts of another person or try to take action they will just end up in court paying out to you for their fault.

assuming you live in the us, most states have a fair debt collection and practices act. what i would do is quote that and put an ad in the paper stating you are not responsible for debts contracted by anyone other than yourself. then you would have perfect grounds to sue and i would definitely do so.

If they touch you get ready for a nice payout by them. No they can not touch you not without penalties!
Do a search in Yahoo answers, I remember once reading some amazing advice there.
