I have an employee who claims that it is illegal for anyone to work more than 7 days in a row...but I'm not finding anything regarding this issue. The Department of Labor only states that overtime must be paid. Thanks for any help!

NO I am not PERSONALLY requiring that ANYONE work more that 7 days in a row--we just want some answers on if its TRUE or NOT

No. From the website below:

"No law limits the amount of overtime work an employer may require. However, all "non-exempt" employees must be paid at least one and one-half times the usual hourly pay for overtime work. Salaried employees who earn at least $250/week and who perform duties that are executive, managerial or professional in nature are considered "exempt" employees and are not covered by overtime law.

Overtime begins after 40 hours of work in a seven day period for companies under the jurisdiction of federal law, and after 48 hours of work for companies under the jurisdiction of state law. Call the Minnesota or U.S. Department of Labor if you have a question about which law governs a specific company. "

Well, for kids under 18, there is a law that states that they can't work more than 40 hours in a week with a maximum of 6 days consecutively. Also, hotel and restaurant workers receive time and a half for all of the time worked on a 7th consecutive day (doesn't matter if they've reached 40 hours).

You might call the MN Dept. of Labor as there are specific requirements within fields and specific jobs. Otherwise, I don't know of any other requirements.

I looked at what the above poster was referring to, but nothing indicates that it is illegal for someone to work more than 7 consecutive days. They just define the pay period. MN State Fair workers typically work 12-14 days consecutively,so I don't see it as an issue other than getting pretty darned tired of working.

It is illegal. See page 2, middle column. Your state gov't site should have your labor laws listed as well, but seeing as it isn't laid out nearly as straightforward as Canada's and all it's provinces' laws (all linked from main site) I can't help you find it. Sorry.

Edit: Whoa.. sorry, at second glance, you're the employer... you need to read up on your laws before you get sued. I suggest you invest in a copy of the current labor laws. Some places sell them on a poster.

No, it is not illegal at all. You are correct in that you only have to pay them for it. If they are under 18 or enrolled in high school, you may not ask them to work more than 40 hours. ZERO overtime is allowed for minors. Otherwise, it's not illegal.

if it's not illegal it should be. What do you think people don't deserve days off? It should be illegal for people to be forced to work more than 6 days in a row. Don't be a slave driver.

If this employee is working retail I feel sorry for him!!! That type of job could make a nun go on a murderous rampage!!!

It's illegal in IL if you require it. If it's voluntary, then it's the employee's choice
