Hear the case of the 3 teenage boys in Merrill, WI who were charged with a felony because of the death of a Foreign Exchange Student who was drinking at a party. Later it was discovered the FES had addisons disease. These boys are charged with his death because they "brought the alcohol" These high school boys are 18 and under, they were not the only kids at the BYOB party. The only reason they were charged and no one else, is because they stuck around to try to revive the FES. I know a lot about this story and am sooo angry over it.. These are good boys. The DA copped a plea bargain that forced the boys to take,due to fear of their own lives, felony is not a joke. Personally, I'd like to know who supplied the boys with the liquor... must of been an adult.

NO they should not be charged,
Rich people with good crooked lawyers routinely get away with murder. This Nazi judge took it upon himself to appear to be tough on crime and twisted the law as soon as he found some kids who he could bully with no regard for justice. This unrighteous judge needs removed from the bench.

The adults who allowed minor children to be out at 3 a.m. without adult supervision are the criminals in this case. The foreign exchange student's host family should not have allowed him to be out at that time of night and those people were taking care of a foreign family's child and should have been doing a better job of keeping an eye on him. How about the adult who owned the cabin and allowed unsupervised minors to party there? How did these minors get the alcohol. You are right - the wrong people were charged.

Standard assumption of Law Enforcement:
The person whom reports/helps is likely the culprit. It's true often enough that if the person(s) involved can't "defend" themselves, or come up with a "reasonable" alibi.

Lazy law enforcement? You betcha...but it works more than it doesn't.

Personally, I'd say fight it, and damn the idiot DA. The question you should be asking is "Why wasn't the home-owner charged?" Since, from the sounds of it, the kids were not at one of their homes.

Besides, I presume the Drinking Age in WI is 21? In which case...how could these "children" have BYOB'ed?

The only reason the DA charged them is because he wanted to have a scapegoat...the plea bargain was given because the DA had no case and they probably would have been aquitted if it had gone to a jury trial..but I'm sure the parents couldn't afford a good attorney so the Public defender gave them some bad advise.
Another reason for the charge..the DA is a political position and has to show he prosecutes people to get re-elected.

The reason they were charged is not because they stayed to help. That faulty thinking is what caused someone to bolt that may have saved his life. Make your case clear and objective if you want to be taken seriously.

No they should not be charged. The only thing they should be charged with is under age drinking. Whoever provided the beer should be at fault,

well did they or didn't they bring alcohol?

they are just as guilty as anyone else who brought alcohol to that party, and illegally drinking it.

yes, they helped the boy out, but they are not absolved of their responsibility to follow the law.

I think they should be charged... but not for the killing of the student. its not like they planned or even tried to kill him.

They're choosing to plead guilty to this felony....I'd say they SHOULD be charged with it if they're willing to "cop" to it.
