I don't think there is anything wrong with being asked to take a drug test. If you aren't breaking the law then whats to be afraid of? Plus its not a form of discrimination. There isn't any "Life liberty and the right to come to work high on crack"

If they were testing for pregnancy or illnesses so they could fire you for being ill or knocked up, that would be a violation for sure. Testing for illegal substances? Not such a bad thing. Would you want the doctor or the person in charge of your banking to be losing brain cells and altering their perceptions with illegal unregulated substances? How about the people your son or daughter works with? Would you like them to go to work at their first job and socialize with drug users/dealers?
Some of those drugs have effects that reach long past the point of when they were used.

Its a great idea. The other side is using "its against their civil rights argument" like they always do when they disagree about something. 1) What right do you have to collect WELFARE? Where does it say that in the constitution. 2) Employers do it all the time to people that actually freakin work. Why should it be any different if you dont work but get a check. So you if you work you get penalized and can't do drugs but if you don't work you get a check and can use them. YEAH that makes alot of sense. LIBERAL IDIOTS.

What they don't tell you is that it also tells them if you are taking prescription medication and can cause you not to be employed! Sometimes used sneakily do decline employing you and Violates your privacy and medical information!

If a person is using Illicit drugs that is one thing, Using Illcit drugs or inebreated on the job that's another. This kind of backdoor prying by employers or potential employers opens the door for a whole lot of Discrimination Lawsuits!

No. Reasons include what has already been cited, including that it is not protected by the Constitution and your "expectation of privacy" in the work place is extremely limited compared to the home. Especially if your job could put the public's safety at risk.

um no...for many reasons. one is this, an employee doesnt have the right to be covered by his or hers companies insurance for an accident on the job due to his or her intoxication. drug testing is NECCESSARY to both prevent and eliminate actions such as this.
doesnt an employer have a right to know 100% the soberness and capable performance of his or her employees...after all..some people put their whole lives into their business..its a controversial precaution they have the right to (and should) take..a lot rides on dependable employees.

Unfortunately no, because there is no constitutional right to do drugs, even if it is in your "off" time. The laws vary state to state, so depending on where you live there may be restrictions on it. Most states, however, allow random drug testing at the discretion of the employer.

It is a violation of the 4th amendment, but the Supreme Court said they could do it anyway.
In other words, the constitution doesnt matter anymore.
They do whatever they want to.

Not at all, you do however have the legal right to decline a drug screening however I can almost guarantee you will not get the job or if you have the job you will 99% of the time be fired for probable cause of drug use.

No, it is not a violation of anyone's rights. No one has the right to violate the law and the company has the right to run the business.
The rest of us do have the right not to have to work with a druggie.
