Of course he should be punished. Those who are saying otherwise are no better than the racist white man who he physically assaulted.
And those who are saying that the "white man" always gets better treatment in our justice system are racist. You are stereotyping. How can you possibly know that all black people who find themselves "in the system" are treated unfairly? Surely you're not relying on what many people refer to as the "white media" for your information? The media is either lying or they are not. You can't pick and choose which information is accurate and which is not.

of course the black guy should go to jail, he broke the law, doesn't matter if someone provoked you or not. he should have just walked away. More important than jail, this man needs counseling to deal with his anger issues, or else he'll be back out on the streets in a few years angrier than ever!
There is nothing anybody could say to me that would enrage me so much that I would go and get a crowbar and start beating them.
All that black guy did was just reinforce the negative stereotypes that racist people have about black men. Does he think he actually proved something? Now all the racist people are just gonna say: see, another black man in jail!
Also, the white guy should be charged if he didn't have the legal right to carry that gun.

Wow, there are some real racist people submitting comments. The guy should get the punishment that fits the crime. The comment made by the other guy was wrong but he didn't deserve to be beaten. If he beat the other guy and made the comment, then he could have been charged with a serious hate crime. Martin Luther King would've preferred that the guy receiving the comment showed restraint and use other means for justice. Now, you got the skinhead waiting for the brother to arrive to prison to toy with.

I would think that it would be more of a passion crime. I think that he would have been justified in giving him a good butt whooping. He went a little far, I suspect that he may have snapped. It happens. He should serve time.
I have got to say this and people are not going to like it. When you insult the fiber of a person, you never know the results. Some people may cuss you out, others may strike you. Others take it to another level. This is why racist slurs should be avoided. It is not worth loosing your life to say something that may insult someone.
*** Just thought of something. The reason that this is self defense is because the man went after his gun. He probally will not get any time. He defended himself because if he had not done what he done, he may would have lost his life. A good lawyer will make sure that he does not go to jail***

What?! They're labeling it self-defense?! That's ridiculous!!!! He should at least get assault and battery charges against him. Yeah, the other guy made a racist remark toward him (who hasn't made a racist comment at some point in their life), but that does not give the other guy the right to beat someone senseless for it!
By the way, did the black guy just happen to have a crowbar in his hands at the time of the remark, or did he leave the scene, get the crowbar, come back, and then beat the guy to near death? If it's the second situation, he should definitely get charged with more than just self-defense.

If truly only a comment was made then the guy should be punished.
Unfortunately freedom of speech covers everything...even hate.
edit.....it is possible the white guy should be charged with something too. If he was actually getting a gun this is surely a threat. I don't know if beating him so bad was called for :-/, but making hurting him just enough to be able to get away!

hmmmm...I thought I had an answer until you added the crowbar AND the white guy running for the gun.
I think this is a result of natural selection in action. Two stupid people meet, and they knock each other out of the food chain. The black guy won't be able to reproduce because he is in prison, and the white racist won't reproduce because he is dead or a vegetable.

Yes, but he should be punished the same way the white guy would have been charged if it was reversed. According to our justice system. You and I both know, he will be charged for beating a "white guy" with a crow bar. It is not self defense if someone calls you a name, call them a name back or better yet laught at them, like I do. I don't condone violence in any way. Unless you hurt my family, my friends, or you are attempting to hurt me. That is a bunch of crap, can you post your source. i did not vote for Obama because of the fact i'm smarter than that & observed with the aid of his skinny hide - additionally i'm Republican. "Blackness" had no touching on my decision. i'm ill of this race card taking drugs each and every of the time too.
