Does anyone know the Statutory Rape Laws in Texas? I have heard that it's not considered Statutory Rape if the ages of the people invovled are 3 years apart or less, can someone please clarify this.

I heard some women at my work talking about it, they said that the 3 years apart thing was only in Texas and California.

I believe that the age of consent in Texas is 17. The age gap you are referring to is for when one or both partners is a minor. It is to say that the gap between the ages of consenting minors should be no more than three years. In other words, it is ok for a 12 y.o. and a 14 y.o. (two year gap) to get it on, but not ok for a 12 y.o. and a 17 y.o. (five year gap).

There's a lot of conflicting information out there. Even the two sources I'm listing don't agree (one has 3 years and one has 2 years for the age gap).

Good Rule of Thumb: If you have to ask, he/she is too young.

Children less than 14 years of age are unable to consent to sexual acts regardless of the age of the defendant.

Sexual acts with children less than 17 years of age and at least 14 years of age are illegal if the defendant is more than 3 years older than the victim.

many times this kind of difficulty isn't formally area of the regulation, it is as much as the police and prosecutor to return to a call if the case is properly worth investigating. i've got on no account heard of somebody being convicted to statutory rape entirely on the know the 0.33 celebration nevertheless, so i'm liable to think of they'd come to a call it is not properly worth their time.
