Most state laws distinguish ages of individuals involved.

For instance, a person over the age of 16 having sex with one under the age of 16.

The circumstances of the matter is immaterial because the law stipulated that a minor under the age of 16 cannot make those decisions involving the ramifications of sexual activities.

In other words...you may think you know everything but the laws do not think you do!

Additionally, it does not matter if the act(s) were consentual or not.

When any law is implemented with arbitrary cut-offs such as age then there will always be people who just fall into the net. However, in the UK, the police would not normally prosecute a 16 year old for having sex with a 14 year old, unless some element of coersion was alleged.

Twenty years ago, I was in this exact position with a 13 year old girlfriend who was more sexually experienced than me at 16 !! I turned down her offer of sex, because, even at 16, I thought it could cause me big problems.

But, to answer your question, when people hear the word "sex offender" they stop listening to any explanations after that.

Yes. Registered sex offenders are often judged solely by title - registries provide only the name, address and charge of the offender. People automatically assume that a sex offender is a pedophile. However, there is a wide range of sexual offenses that have nothing to do with pedophelia. I'm not in favor of removing the stigma faced by sex offenders or the pariah-like treatment they receive. I will agree, though that the public information available is unfair. Good luck -

Unfortunately, willing sex or not, if her parents press charges, you are going to be judged specifically by the title sex offender. Most won't ask why.

I am a parent and it said how you now have to take responsibility for their child's actions.

There are no facts other than age. Even if the girl lied to you about her age, if you slept with her then society considers you GUILTY. People will want to tear you to pieces even if she threw herself at you while you were drunk or unconscious. Welcome to America, where you get less time for killing someone than having consentual sex with them.

Yes they can. Unfortunately, the laws don't protect children who do adult acts.
