The lease is month to month not a year and both there names are on the lease but my daughter gave her notice three weeks ago I need a attorney to answer this question

The lease will stipulate how much notice she has to give. You need to read the lease, also, it depends on your state so you need to look up landlord tenant law for your state. All the legalese should be in the lease itself. On a month to month lease she may terminate the lease anytime she likes given she follows the lease's outlined statute, he may have a 60 - 90 clause. If she gave a security deposit she may not get her half back until her boyfriend moves out. Read the lease, see what the termination period is, look up landlord\tenant law for your state. Many states require that if you wish to terminate the lease, the landlord has to show it to try and lessen the financial burden to the tenant. Many landlords are jerks though, I recently had $3000 (my sec deposit) and had a hard itme getting it back because I had moved out of state and couldnt fly back for a court date. I even had a signed reciept from the landlord saying they owed me $2800 returned to me, they gave me a big fat $90 check (the other 200 was for cleaning services they charged me for when I could prove I had the place professionally cleaned). So it is likely you may have to hire a lawyer anyway.

Your daughter must give her notice one full period in advance for it to be valid. Otherwise she owes for the next period. Basically, if there's only 3 weeks left of the period and she gives her notice, her notice is not good. Her notice will continue another 4 weeks, for which she is liable for rent.
