My sister was involved in a four car pile-up yesterday on route 51 leading into Pittsburgh, Pa. Everyone started driving away, but my sister made the lady she rear-ended stay until police got there. I'm not sure about what happened after the wreck. But today, just an hour ago, an "insurance agent" from the women called my sister. He said the conversation was being recorded and demanded that my sister answer questions. She did. Was it illegal for that insurance guy to do this? He was threatening my sister that if she didn't answer the questions that he would use the tape as evidence. What should my sister do without really getting a lawyer?

If she already answered questions as to responsibility in the accident on tape, she already let the horse out and its a little late to lock the gate. The only thing she should have done when the ladies insurance agent called her was to give him the name and number of her insurance agent. You pay those outrageous premiums so that they handle situations like this. Tell your sister not to talk to anyone else until she has talked with her insurance carrier and then to follow their advice. She needs to let her carrier know what she has already said to another agent.

All phone converstations are recorded anymore, and they tell you this up front. This is to protect both parties in the conversation. This is legal because they informed you. You do not have to answer any questions. Depends on what kind of questions were asked. Did he just want to know her side of the story? Her insurance carrier was not there, so all they know is what she told them, so they do need to hear it from her. I would just answer them unless the questions had no relevance to the accident. Anything else, I would leave to her insurance carrier to sort out.

No, it is not illegal at all. Your sister should not have answered a single question, nor should she answer any more. Your sister should tell her insurance company what is going on. If she is contacted again, she should hang up immediately.

no it is legal for him to do this, of course what your sister was suppose to do was say no, that her insurance would contact them, and that she would make a statement to them. Then hang up.

Of course he was threatening, he wanted her to say as much as she would to make her more guility.
