The offenece is taking a conveyance w/out lawful authority. The conveyance belongs to the wife's brother who is on holiday and has left the keys with the wife. On the day of the offence the wife makes a statement that D did not have permission. On week later she states that he did have permission but at the time she said he didn't becasue they had had an argument. The wife will not give ev in court. Are both statements admissible? What is the best course of action for the defence?
