I don't think that areas of law are created in the sense you mean. I think that they arise out of particularly felt needs and, when they achieve a certain critical mass, they are named, possibly several times before a particular name sticks.

the various laws are in place to encourage business people to be successful. A good businessman would have probably followed these rules anyway. It forces you to make the best out of your staff.

It is human nature to exploit others
finally laws are enacted from the need to stop it.
of course sometimes the laws are made by the exploiting
s.o.b. and then you get things like workhouses and army
troops as strikebreakers.
