I think it would be a good idea, because, say a "woman" with a penis goes into the men's bathroom. There is a good chance that someone is going to freak out, and maybe physically harm her. If "she" goes into a women's bathroom, and someone catches her, she could get sued for indecent exposure. I think its a good idea.

No, actually, I don't think so. Many transgender and transsexual individuals are closeted about their true gender identity, and with good reason- people who are so revealed often are the recipients of violence and other brutality. Somebody seen to be walking into a bathroom explicitly labelled as "transgender" will instantly become a target.
Not to mention that most trans individuals want nothing more than to be considered the sex they actually feel they are. Really, if you don't have much experience with trans people, you'd be amazed to find how many transmen are literally estactic and gleeful the first time they go and pee standing up in a real men's room. Denying them their existence as a person of that gender is a sad thing.
Personally, I think all of our bathrooms should be made unisex anyways. Not only does this solve the problem for transpeople, who wouldn't get harassed for using the "wrong" bathroom, and wouldn't have their gender identity and trans status revealed the way a transgender bathroom would, but it just makes more sense overall. How many times have fathers with young girls had to entrust their daughters to complete female strangers to go into the women's bathroom, just because it's the Women's restroom? Doesn't that seem a little ridiculous to anyone else?

There's no need. If bathrooms are segregated based on biological sex then a transman would simply go to the "Physical Female's" room and a transwoman would go to the "Physical Male's" room.
If bathrooms are segregated based on gender identity then a transman would go the "Men's Room" and a transwoman would go the the "Women's Room".
Really the question should be whether, if we're separating by biology there should be an Intersexed bathroom for people who aren't physically strictly male or strictly female, or if we're separating by gender identity whether there should be a bathroom for people who don't identify as male or female or who identify as being both.

You have really been thinking to much, I think they should use the bathroom which matches there look the closest either male our female and use the stalls, Now what I would like to know if it is a woman with a penis do they still get mad when a man lives the seat up,

There are the unisex bathrooms people have mentioned.
From a personal experience: I've been to a few ladies restrooms and encountered women who were "packing". It didn't bother me. I was thinking more about their good fashion sense than about their biology.

Yeah, like a person before me said...all toilets are enclosed. I've never been to a restroom where women flash their titties and cooches all of a sudden...so as long as they don't pop it out then they can't get caught. I've already shared a few restrooms with transexuals and I don't mind at all. They don't bother anyone...they're just in there to piss and apply makeup just like everyone else. So what's the big deal?
Stop being so uptight...maybe you're the one that needs to change...not the friggin restrooms.

since all the toilets in the ladies room are enclosed (i'm assuming) i son't see how anyone could "catch" her. i think it's a non-issue
