My buddys roomie doesnt pay his rent, they are facing eviction. Both are on the lease. is there something the paying one can do to make the other pay, legally (or otherwise.)

Only legal recourse is to pay the rent or face eviction; however, the paying roommate could sue the non-paying roommate in Small Claims Court and likely easily get a Judgment provided they have keep good records. The downside is that if the roommate does not have job or any assets, all that the paying roommate gets is Judgment that will show up on the non-paying roommates credit report for 7-10 years and try to collect via a garnishment of wages once the non-paying roommate gets a job (but you would have to know where the non-paying roommate is now working or good PI).

If the non-paying roommate is not legal savvy, it might be better to verbablly request that they move out within so many days as a paying roommate is needed and going to move into the non-paying roommate's room as soon as one can be found.

The paying roommate need to get a credit check and employment check/verificatio to ensure that the next roommate will pay their share. Unless you are in love or related (and even then it is tricky) a living arrangement should be a business arrangement.

he might want to see if there is a clause in the lease stating if one roomate breaks the lease the other can or if so chooses to stay. i'd say make the deadbeat break the lease and owe the landlords.
or your buddy can break the lease, pay the landlords and leave the other dude to be evicted.

has the rent ever been late before is this the first time. things happen she should of left a check for the rent so you could avoid the late fee but some people dont think that far ahead. you may be making a fuss over nothing

Unfortunately; if both parties names are on the lease; both are responsible for the full rent. If party A; fails to pay; party B is not ex-solved. Both can equally have a negative mark on their credit report.

Legally, he is responsible, but getting blood out of turnips has always been difficult. If it were my roommate, I would throw his crap out in the front yard and tell him it could come back in when he paid his share...I am kind of bold that way.

Small claims court. But I am kind of surprised that they are both being evicted. Usually it is just the one person. I would fight getting tossed too.

theres not much, unless a contract was drawn up

although if ur buddy paid more than his fair share, then maybe u can sue him in court
