My husband was charged with shoplifting over 15 years ago in California. He is trying to get his contractor's license in another state and they only need the police record if it's a felony.

He was arrested for stealing a shirt or some pants - I can't remember the details, but it wasn't a very expensive item.

I'm guessing it's a misdemeanor, but I need to be sure. I'll probably call the police department in California tomorrow, but thought I'd get some opinions first.

In California theft of a value less than $400 is petty theft, which is a misdemeanor unless the person has prior theft or theft related convictions. (Penal Code section 484.) Unless he was shoplifting at Dolce & Gabbana, he probably did not reach the level for grand theft (Penal Code section 487.) Even then, grand theft can be charged as a misdemeanor, and often is in shoplifting cases. In rare circumstances, a shoplifter could be charged with felony burglary, but I very much doubt that such a charge was made in this case.

Bottom line, it is almost certain that this is a misdemeanor conviction. Your husband might also want to talk to an attorney about obtaining Penal Code section 1203.4 relief. It is called "expungement" but it really is not that good, but it has some benefits. Most attorneys will charge a few hundred bucks to do it.

From my experience there really isn't a "shop lifting" charge - it's theft and it typically is based on the amount stolen that determines if it is a felony or a misdemeanor. Depending on the seriousness, a plea bargain may be offered. The main difference between a misdemeanor and a felony is that a misdemeanor involves a punishment of up to a year in jail and a felony involves a longer prison sentence. If a plea bargain is good enough, it could be simple probation and fines, depending on the situation.

Shoplifting is almost always a misdemeanor, if you steal a very expensive item it could increase to a felony.

It depends on how much he was charged with stealing. A candy bar is a misdemeanor. A truck load of big screen TVs is a felony. I don't know the dollar amount CA uses as a cutoff.
