As I hope responsible landlords, we wish to put the fabric of the property back in good order and then sue the management company for the costs of the repairs that they have not done. Can we add a premium to our claim to cover our time and incidental costs.

Your question is a legal one- so I will admit ahead of time that I am answering as one knowledgeable but in no way expert. In my _limited_ experience, reasonable costs for time/incidentals can be recouped, assuming legitimate, specific records are kept.

Additionally, you could possibly recover past payments to the management company... if they are insured (they should be), their underwriter should be a part of this discussion as well.

Keep records of everything- with dates/times, including phone calls, witnesses, the nature, tone, and participants of conversations.

It is time to engage an attorney.

I believe a consultation with an attorney is in order. Should you try what you are proposing to do, you may be out a lot more money than the visit would cost you.

I would write them another letter telling them that you plan to have repairs done. If they still to not respond, have the repairs done and take it out of the rent. Give them a copy of the invoice when you pay the rent.......

DISCUSS YOUR INTENTIONS WITH AN ATTORNEY, BEFORE YOU DO ANYTHING ON YOUR OWN. YOU MAY HAVE RIGHTS IN ONE OR TWO OF YOUR AREAS BUT NOT IN OTHERS.....HOLDING BACK RENTS AND MAINTENANCE FEES IS A TRICKY AREA TO GET INTO. YOU CAN TAKE THEM TO COURT AND ALLOW THE COURT TO INTERVENE ON YOUR BEHALF....DON'T DO ANYTHING ON YOUR OWN OR YOU CAN WIND UP ON THE SHORT END OF THE STICK.....CALL A LAWYER! BE SMARTER THAN THEM.....THEY HAVE THEIR LAWYERS TO GET OVER ON YOU....YOU HAVE YOUR LAWYER TO MAKE SURE THEY DON'T....
