I am an official convict now.....Saturday I was arrested for possession of alcohol in front passenger floor. Nothing was open and no talk was made, just get in the back buddy!!! I also would like to know why he told my parents they couldn't get me out until sunday. I was arrested around 4 pm. Instead i was released in 3 hours heading home. I believe he wanted my mom to suffer on mother's day.

If you are a minor or under 21 then you are in the wrong and you should be punished. Also having an open beer in some state will get you a ticket. But it all depends on where you live. Steve McNair, the quarterback for the Ravens was charged with D.u.I. and he wasent even driving, so check with your local police station to see what the law is in your city.

I don't know all of the circumstances of your situation to answer this truthfully. Did you pick up the alcohol from a friend or family member? Were you pulled over originally for speeding?

If you are under the age of 21 you can be arrested for being in possession of alcohol, even if it is currently not in use.

If you are over the age of 21, then the police officer really had no reason to arrest you, even if all alcoholic containers were still sealed. Depending on what your situation was, I'd hire a lawyer and work to get the charges dropped, and your record cleared.

In some states it's illegal to have alcohol in passenger area regardless of it being open or not. Your supposed to put it in the trunk when transporting it.

The other issue could be a minor in possession of alcohol?

Go to jail, unlikely. Lose your license, very likely.

If you were under age, that was the kicker. If you were of age and it was not open, then no problem in states that have open container laws.

If you don't want to hurt your mother on mother's day then don't break the law. Don't blame the fuzz for your decisions. It doesn't make sense and makes you look ignorant, which you probably aren't.
