i defaulted twice in one year on a debt i owe to a lady i pay her at the rate of £10 a week as agreeded by both of us,i am currently out of work and struggling at the moment,she has sent an open post card through the post for the whole world to see,for example,unpaid default,county court action pending,past due and the account is now overdue,i know i owe the money and will pay her as fast as possible to get her off my back,but shorly telling the whole world cant be right,the postman now knows and the sorting office and god knows who else would apprieciate some advise.

I would guess she is trying to 'shame' you into paying up ...

NB. As far as I am aware, a postcard is still regarded as a private communication = i.e. it is only supposed to be read by the person it is addressed to .. so if the postman reads it, it is the postman who is breaking any Privacy law..

PS You might be able to do her for Libel if anything she wrote is untrue ..

I don't think she can. In fact someone once told me that if a debt collector is at the door and talks too loud and someone else finds out your business then you don't have to pay the debt because your privacy has been breached. I don't know if this is true though so check with Citizens Advice or local advice centre.
Privacy is a serious issue with debt that is why they won't even speak to the wife/husband if the debt is in the others name. Also why they ask security questions to be sure they are speaking to the correct person.
I would definitely take this further.

If what she says is true then I'm afraid it's tough luck. If she wanted she could put an advertisement in the newspaper. It's just a tactic by her to get you to pay up quicker by shaming you into finding the money from somewhere.

I agree with the last person, I think it might be tough luck for you. It's not fair for her to loan you money and you not pay her. She did it out of good faith to help you. This should be your number one priority. It's not her fault about your life. You are not a child be accountable.
