I'm divorced 3 yrs now. Many time he missed his maintenance payments. He pays an amount per child as well as the schoolfees. All into my account. Usually I paid the schoolf from the first amount that enters my acc. Lately he only paid a sum, equal to the schoolfees, nothing else. Am I legally binded to pay the schoolfees first? It's not stated so, anywhere. There is no way to keep my household running without the rest of the money. Last 2 months I did not pay the school, as I needed money in the house. Can he or his lawyer expect me to do so?

As long as child support is going for the benifit of your children, housing, clothing, food, etc. then he has no say so at all. Use the child support for your household expenses and then pay school fees from the amount he pays for that. Make sure he knows that the school fees are due and he will have to pay them if he is not going to put the funds into your account. School fees are separate and not a part of the maintenace fees. Contact him and tell him the school fees have not been paid for 2 months and that he needs to get the funds to you immediately. Good Luck.

The only thing you are obligated to do with the money is make sure your kids are taken care of. If that means buying your kids new school clothes or making sure they get to participate in an activity, so be it. No, you do not have to report your spending to your ex.

If he has a problem with it, have him contact your attorney. If the court records do not indicate a receipt for all spending has to be submitted to the ex, his requests for them are not important.

The fees for school should be paid, don't get me wrong, but I know what it is like to scrape by at times. If he is not holding his end of the legal binding, he neds to be reprimanded by the court. There should be no reason for his lateness in getting you the called upon maintenance on time EVERY month.

Contact your attorney, yourself and let them know what is going on and tell them your fears. They will give you the best advice.

It sounds like you got it hard right now. I'd check with my lawyer to see if there is a violation of court order. I don't know how you have the payments set up, but you can have them automatically taken out of his paychecks. That way he doesn't have to make a deposit of the amount he wants, the courts will take out the amount they set up in the first place. Just ask your lawyer about all these. I really do wish you well.

Yes, you are legally required to pay the school fees if the court ordered him to pay them, and he is giving you the money for them.

If you are having financial difficulties, take him back to court for additional child support, or get a 2nd job.

Why no! You put the money where you want to spend it. If he is not keeping up, turn it over to a child support agency. They will collect it for you with interest! It will come from his check before he even sees it.
