In California there are NO laws that pertain to fault in car accidents. Each case has fault decided on an individual basis. There are too many variables to just assume that a driver who hits a car in front of them is responsible. It always depends on the situation.

Insurance & law wise, It's almost always the person who hit the car from behind, possible exceptions being if you changed lanes improperly or cut in front of someone. The rationale being that even if you slam your brakes for no reason, the person behind you should have left enough distance to avoid you.

Most likely, it is the fault of the person who hit the car in front of him. There are exceptions, like if you cut in front of him and then slam on your brakes. good luck
