If you are having sex, you are trespassing on another person's property. Marriage makes the couples responsible for each others safety.
Having intercourse with another person other then their marriage partner can be considered to be endangerment.
If you get the person sick and person gets the married partner sick you have provided cause for a divorce and possibly are going to be the person responsible for a lovely 18 years of unwanted anguish.
I hope person hasn't given the marrried partner AIDs, the partner doesn't give it to you, or vice versa you don't give it to partner. Because you could be a carrier without even knowing it.

Only in various religions. It is, of course, grounds for divorce but you can't be arrested or fined for it. Actually, you probably could be either of those based on some of the outdated laws some areas have but in reality I doubt anyone would actually follow through on it.
