First off let me say this, I think our "Family" laywer is a dirty laywer, working for the other side. I allways thought this, but my dad is best friends with this guy (in a bisness sence, no social thing) and swears by him. Recently I got in some trouble at school, basically some one took something, then said me and him did it together. So they (school Assistant principal and Officer) started questioning me, then paused and asked my age (16 for 2 more weeks), then continued to question me, never asking if I wanted my mother or dad there, nor a lawyer.

I was at my dads talking to our "Lawyer" and I told him what I just said, about the asking my age and what not, and he said we could sue them because they cannot question a minor with out a parent, gaurdian, or lawyer there.
I persinally think he just wants me to try and sue them, so they can counter sue me for a whole list of things, and I think they hired him to get me to sue them.. so is that illegal to question me with out parent

Yes is is a city cop, worked for the city patroling our streets for years, then came to our school this year... and he was asking me the questions..

As long as the police where NOT present they can ask all the questions they wish. There's NOTHING illegal or improper about school officals asking questions. It becomes illegal if they bring in the police and fail to get a parent present.

There's no way that he's representing both you and the school. He would lose his law license, and not be able to practice. Also there would be no way that he would be able to represent both while in court, since it would be obvious.

If you believe he is doing so though, contact the state bar in your state and file a compliant. They'll investigate it and take action if needed against the lawyer.

Was this cop employed by the city, or the school? If he's a school employee he'll still be covered as a school offical. If however he works for the city police force, and is stationed at the school, then yes he should have called for a parent to be present.

Your father's lawyer is correct. They should not have questioned you at all, for any reason, without your parent being present. Yes, you can sue. No, they cannot counter sue you for anything from what you posted here. Also, they wouldn't bother counter suing you because of your age. At 16, you have no assets for them to collect on, so you are of no value to them in a lawsuit.

Just remember this rule, "you have the right to remain silent" No matter what your age, you don't have to answer any questions asked by principals, police, etc, etc. If they want to build a case, make them do the work without your help.

if a cop or a state police did not ask you, there are no rules,.....who ask you the questions?,.....if the person who ask you the question, does not have the right to ask,.....well what the fuc&,.........carriy on
