Ethically, privilege should start when the atty. agrees to take your case. Legally, privilege applies once you have paid the retainer (either in full, or a portion that you and the atty. have agreed upon).

The retainer is the money you pay a lawyer to make his or her services available at your need. It is only the information exchanged between you and an attorney you have hired that is priviledged.

yes unless the client initiates a malpractice lawsuit against the attorney then the privilege is removed to allow the lawyer to defend themselves

basically any work product produce by the lawyer in regard to representing the client is privileged, unless used for trial
