He is not guilty of murder, but is most assuredly guilty of false imprisonment. They chose to try to escape and plunge to their deaths. Superman did not cause the death. He merely held them against their will.
He could be charged with criminal neglegence, and find himself in big trouble, because his captives did die.

It would be guilty of an imprudently murder, what I mean is that even though Superman did not try to kill them, his actions lead to that awful result, and there should have been a punishment even if it is softer than a first degree murder.
