The Theater of Pompey was the first permanent theater in Rome, built by Pompeius Magnus, a.k.a. Pompey the Great, one of Rome's most successful military men, around 55 B.C.

The theater of Pompeii refers to a theater in the Italian town of Pompeii, which was completely buried along with all of its inhabitants by an eruption of the volcano Vesuvius in A.D. 79, and rediscovered in 1748.

Does it really matter? Pompey and Pompeii are simply homonyms. But you are correct, they are two different places.

Those who did not know of the existence of either are moot for this question.
