we had to leave our council house due to harrassment and violence from neighbours from hell we were moved for our own safety by the police. we made a homeless application to the council to be rehoused however as another council found us unintentionally homeless as it wasn't safe to return to our property my council who knew all about the situation then said 2 wks after i'd been found homeless that i'd abandoned my property and charged me 4 wks notice on it. morally this seems very harsh as we lost everything we owned but can they legally do this, we are currently unable to obtain council housing due to this. Any advice is appreciated.

not understanding because of your misuse of terms (counsel = lawyer or legal aid or someone who gives you advice/help / council - a body of people that determine things)

if you were living at a residence, you'd have to follow the laws of your state concerning tenants and evictions. you should have given 30 days notice, even if you moved out earlier. otherwise, they can still charge you because you didn't notify them that you were permanently leaving the residence.

due to being moved for your own safety then the council should see this in your favour,my advice would be to contact the citizens advice bureau for help sorting this out,you should normally give 4 weeks notice on a property but under these circumstances then the council should make an exception,unfortunately for people the neighbours from hell stuff does happen and unless others stick together with you and gather evidence then its hard to get something done about it.after all its your word against theirs and usually the troublesome ones are making claims of harrassment as well.council rules are strange things and sometimes have no reasoning to them. good luck.

Seems very harsh indeed.

I'm assuming you have already spoken to the Council and explained the situation and they refuse to assist you?

I would suggest you speak to the Citizens Advice Bureau to find out the legal position. In the meantime, see your local councillor, they might just make the idiot bureaucrats see sense? It might be worth getting in touch with your local MP too. Remember, these people are elected to help you.

If you haven't already get straight down to your local Citizens Advice Bureau, they will be able to help you with this. It doesn't seem right that they are doing this as you had to leave and as your Landlords they have an obligation to ensure you are safe and free from abuse in your home. If you still have it read through your tenancy agreement it may say something in there about it. Also go to the Shelter website they have plenty of info on there that may be useful to you.

If you were moved by the police, why did'nt they or you for that matter, go to the council to explain . if the council knew , then can't see how they can charge you.

sounds like you have a case

since you couldn't stay it was like an emergency move

just get a lawyer to help you on this one

long as you left notice when you left

then they knew you would return for your items

in a reasonable amount of time.

so they owe you something.

you couldn't stay in an unsafe environment - you have documentation to prove that
