My Fiances (hopefully soon to be ex_) wife had him served with Divorce Papers last year in May.He signed everything,had a witness sign it,got it notorized and returned the papers to her.Due to (so she says) finacial problems she never had this divorce finalized.Is it possible to still turn them papers from May last year in NOW and get the divorce done???

Divorce laws in VA are really tricky because they're based on both modern laws as well as laws dating back hundreds of years. His best bet is to contact a lawyer about it. Hope he kept copies of all the paperwork so he atty won't have to do all that much work.

But he really needs to cough up the money and hire a lawyer.

Virginia law recognizes two types of divorce: divorce from bed and board and a divorce from the bond of matrimony . A divorce from bed and board is a partial or qualified divorce under which a husband and wife are legally separated from each other but are not permitted to remarry. A divorce from the bond of matrimony is a complete and absolute divorce. Any person granted a divorce from bed and board may ask the court to "merge" the decree into a divorce from the bond of matrimony after at least one year has passed from the date the parties originally separated.
