First, let me say that I am sorry for your loss.
In Florida and in several states it is illegal to scatter ashes in a public area. Contact your local city office and ask what the local laws are. They will more than likely give you a list of acceptable sites for scattering. I doubt it. Once you have a human cremated I think whoever is in possesion has free right of what to do with the ashes. I hope this was in want of the deceased you were talking about. But I would contact the police department before you do it to be safe.

I wouldn't think so. I mean people do it all the time. It's ash so their is no environmental inpact.
